CLUB RULES AND WHAT YOU NEED TO KNOW

Opening Hours

Monday to Friday: 24 hours (manned 9am to 7pm)

Weekends: 24 hours (unmanned)

Membership Definitions

Adult: Application for everyone over the age of 18 years old, or 16 years old if a parent or guardian will pay the monthly subscriptions and be responsible for under 18’s conduct. At the ages of 16 and 17 a prospective member must have the permission of a parent or guardian to join. The same parent or guardian shall be responsible for ensuring that the Club rules are adhered to and that their membership fees are paid in line with the terms and conditions of direct debit collection. In addition to this, members aged 16 and 17 must sign a Behavioural Code of Conduct and provide valid ID as proof of age.

Membership Categories

Full Membership: Entitles full use of the Club facilities

Blue Light memberships: Entitles full use of the Club facilities

Membership Rules

You are not permitted to bring pets (other than guide dogs) on to the Club premises.

Crockery and glass in any shape or form is not allowed in the Club.

We reserve the right to use any individual or group photographs or movie shots for press or promotional purposes. Where possible we will ask you to sign a use of image form.

Persons who appear to be under the influence of drink or drugs will be asked to leave the Club.

Any person whose behaviour is deemed inappropriate by staff, will be requested to leave the Club. Any incidents of this nature should be reported to a member of staff immediately.

All equipment, staff and fellow users must be treated with due care and respect.

Appropriate footwear and clothing must be always worn whilst in the Club.

Please use the storage provided for your personal belongings.

All lost property found on the premises should be handed into the club reception. No underwear, hairbrushes, shampoos, soaps, deodorants, or similar products will be kept in lost property; they will be disposed of immediately. All other items will be kept by the Club for 14 days and then donated to local charity.

All members must complete a New Member ParQ within the first 7 days of their membership. They may then choose to book a gym appointment.

Members are particularly advised not to undertake strenuous physical activity for which they may be medically unfit.

All members use the equipment and facilities entirely at their own risk and the Club do not accept responsibility for any harm or injury to any member however caused.

Members who have any reservations as to their physical condition are advised to have a medical check-up before embarking on any exercise.

The Club reserves the right at any time to, and without notice, to remove facilities for maintenance and refurbishments.

Smoking and e-cigarettes are strictly prohibited in all areas of the Club, inside and all outside areas.

The Club reserves the right to refuse any person admission to the Club without reason.

 

 

MEMBERSHIP TERMS

Principle Terms

This agreement is an agreement between you, us and ClubRight 

1.     This agreement commences once you have indicated your acceptance in the Declaration section of this web sign up process or during the sign-up process over the telephone. 

2.     Your membership will begin on the day that you apply for your membership and will run for an ‘Initial Period’. The ‘Initial Period’ for a rolling monthly membership is defined as one full calendar month starting from the 1st of the month after the date of your membership application. By confirming acceptance of our Membership Terms & Conditions, a legally binding agreement between the member and Mammoth Strength Club Ltd. is formed. Your acceptance of our Terms and Conditions will be recorded and stored by MSC.

3.     Discounted/Blue Light membership: evidence is required that you are employed by, or a member of a relevant organisation. Any discount will only be applied once evidence has been validated.

4.     Your membership starts immediately but you have 14 full days after sign-up to cancel this agreement for any reason. (This does not apply to anyone who signs up in club) To exercise this right, you must inform the club of this by email mammothstrengthclub@gmail.com. If you exercise this right to cancel and, if applicable, we will reimburse you all membership fee payments received from you (excluding the initial payment made on joining) using the same means of payment you used for the initial transaction. If you have used the service before requesting to cancel, then we will reduce your membership fee refund by a pro rata amount equal to the number of days from signup to the date cancellation was requested.

5.     From time-to-time MSC Ltd. may offer free or paid trial offers. These offers will be subject to their own terms and conditions which will be available to any participating member. You must provide us with a valid payment method to initiate a trial offer. Upon expiration of the trial period your membership will automatically renew at the relevant monthly or annual fee as applicable. MSC Ltd. will automatically charge your default payment instruction. If you do not wish to continue your membership after the promotional period, you must give us one month’s notice in writing prior to the end of the trail period

 

Fees & Charges

1.     The Initial Payment for the initial period or paid in full annual fee is due from you to us, is payable immediately and is not refundable other than in the event of breach or negligence by us.

2.     The Direct Debit Payment Amount is due from you to us. You are obligated to make the “Minimum No. of Direct Debit Payments” stated (x1) with the first one being paid on the 1st Direct Debit Payment Date and then every month thereafter. You are obligated to make every Direct Debit Payment regardless of non-attendance, except where the cancellation terms below are met. See Cancellation section below.

3.     If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid  or if any other form of payment is not honoured for whatever reason, we will attempt one further collection. A fee may be incurred for failed DDR collections. Payment of the subscription will then be attempted by card, from details held on file.

4.     You agree to advise us promptly of any change to the members’ details provided. If you fail to pay any amount due under this agreement for a period of more than thirty days, then we may pass the debt to a third-party company for collection. The reasonable and direct costs incurred in employing the third-party company will be borne by you including costs in tracing you if you have changed your address without telling us.

Automatic Renewal/Continuation of Direct Debit Payments 

1.     We will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal Direct Debit payment amount may only be amended if we advise you in writing giving not less than 30 days’ notice. Please note if your membership included the benefit of a free period then we will stop making collections during that free period and recommence making collections on the renewal date.

2.     You may prevent the Automatic Renewal at any time by giving us written notice, minimum of two weeks prior to subscription date, via email, mammothstrengthclub@gmail.com. When the final minimum period payment has been taken you should also cancel your Direct Debit mandate directly with your bank.

3.     Once you have completed the minimum number of Direct Debit Payments you can cancel your automatic renewal by giving us written notice via email mammothstrengthclub@gmail.com.

4.     After the final payment has been taken you may also cancel your Direct Debit mandate directly with your bank.

Non Payment of Membership Fees

1.     A £10 charge will be made for all failed payment collections.

2.     Failure to pay all applicable charges may result in debt recovery actions being invoked.

3.     We will contact you to let you know if your monthly payment fails. You will be required to make an immediate BACs or card payment to clear the arrears.

4.     If you do not pay for your membership, your access to the facility will be restricted. This does not mean we will end your membership.

5.     Cancelling your Direct Debit does not mean you have given us notice to end your membership. You must give us written notice in line with our notice policy (see ‘Cancelling or Ending your Membership’).

6.     Where a Direct Debit has failed or a member has purported to have cancelled their Direct Debit without prior agreement, the membership may be suspended until payment is received. Any member who falls behind in payments for more than 1 calendar month will forfeit their membership. Upon failure to make payment, subsequent reinstatement of the membership or any future membership will be subject to the outstanding membership fees and £10 admin charge being paid in full.

 

Enforcement and Termination

If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.

We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us, you must do so within the United Kingdom. Relevant UK law will apply.

If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.

We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e., stealing, or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily to qualify you for a refund or no further payments.

Cancellation

1.     All members must provide the club with a minimum of 2 weeks written notice prior to subscription payment date, to terminate their membership. If a subscription falls due within the 2 week notice period then this payment will be due.

2.     The notice period will be deemed to commence on receipt of the written notice. Termination will be effective at the end of the subscription period. We calculate your membership in whole calendar months. This means that the following applies : If notice is given less than 2 weeks before the subscription is due, we will treat it as if we received it on the first day of the following subscription period, and the notice period will run from that day. For example, if you give us 2 weeks notice to end your membership and we receive this notice between the 1st and 14th February, and your subscription is due 10th February, your notice will start from 11th February. Your membership will end on 9th day of March, and you will pay your final Direct Debit on 10th February. If notice is given before 27th January the membership will end 9th February with no further payments due.

3.     There are no exceptions to this rule.

4.     All memberships will run to the last day of the month of the notice period.

5.     You must not cancel your payment instruction until the notice period has expired and the membership ends with no outstanding payments due.

6.     No refunds will be given for non attendance. No refund will be made for the initial payment on joining. Cancellation requests must be submitted in writing to:  mammothstrengthclub@gmail.com

** A cancellation of the direct debit mandate alone is not considered a valid request to terminate the membership and the club will be entitled to take other means of payment or seek to collect any monies owed. Cancellation of a Direct Debit mandate without notice will be seen as a breach of this contract.

7.     Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury, or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.

8.     Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

9.     Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given.

10.  Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services, you may reasonably expect, and we have fallen well below that standard.

 

 

 

Membership – minimum term

1.     Unless you end your membership under the 14-day cooling off period or we cancel it, it will run for the relevant ‘Initial Period’ and will then continue indefinitely until you give at least 2 week’s written notice, in line with our cancellation policy.

2.     Your minimum commitment for a rolling monthly membership is defined as the first full calendar month of your membership together with the part of a month, referred to as the ‘Initial Period’ on joining.

3.     Your minimum commitment for a 12-month minimum term agreement is defined as the first 12 calendar months plus the part of a month referred to as the ‘Initial Period’ on joining.

4.     If you want to end your rolling monthly membership at the end of the ‘Initial Period’ you must give us at least 2 week’s written notice, on or before the first day of the first full month of your membership and at least 2 weeks before the subscription is due.

5.     An exit fee of £10 will be applicable if the membership is terminated before the minimum term is completed.

Freezing

1.     Temporary Illness or Injury: This agreement may be frozen in the event of a temporary illness, injury, or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period.

Please note – ANY Freeze will not take effect until the appropriate proof is provided and received (in writing via email mammothstrengthclub@gmail.com) to the club’s Membership Administration Department.

2.     Freezing for another reason will be at the discretion of the club.

3.     Freeze periods must be for full calendar months for a minimum of 1 month and a maximum of 3 months. Only one suspension is permitted within any 12-month period.

4.     The monthly payment instruction must not be cancelled during your suspension, as payments will need to restart on your return to active membership.

5.     Throughout the time any membership is frozen, we reserve the right to charge you a nominal monthly fee for each month that the membership is suspended.

6.     Your membership will automatically restart at the end of the freeze period. Please note we do not send reminders.

7.     Backdated freezes will not be allowed.

Please note – A freeze period does not affect the Minimum No. of Direct Debit Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence monthly once the freeze period has completed.

8.     A Member who has “frozen” his/her/their membership will not be allowed access to the club.

9.     MSC do not charge to freeze a membership plan.

Membership QR CODES

1.     A Membership QR Code will be issued to every member via the ClubRight app. This is time sensitive and can only be used once.

2.     QR codes cannot be shared, any member found doing so will be suspended, then we may terminate your membership without any refund.

3.     Every member must swipe his/her/their QR Code on each visit before proceeding into the club.

4.     Any member attending the club without a valid Membership QR Code may be asked for proof of identification. Membership is only valid for the named member and cannot be used by anyone else. As such, you may not give your membership QR Code to anyone else or allow the QR Code to be used by anyone else. If you give your membership QR Code to another person, then we may terminate your membership without any refund.

5.     The club reserve the right to refuse entry if a valid membership band is not produced on entry of the Club. A member may be granted access to the Club on a temporary basis should they forget their device, proof of membership will be required by reception.

6.     The Club reserves the right to refuse any person admission as a guest to the Club without reason.

7.     Tailgating is not permitted, any member found doing so will result in their membership being terminated.

 

Equipment

Any person who removes, damages, or destroys any property of the Club shall be responsible and liable for the replacement or repair of such property at his/her/their sole expense & shall indemnify the Club against any costs or expenses however incurred by the Club in repairing or replacing such property. Prosecution will follow in certain cases.

 

Gym

To promote safe exercise please ask for assistance from the team before performing unfamiliar exercises.

Rules:

1.     Scan in.

Every member/guest must check-in to register their gym attendance. Failure to do so is a breach of our insurance, and health and safety policy. Tailgating is not allowed, members found doing so will be banned.

2.     Personal Training.

Members are not allowed to provide others with Personal Training unless otherwise arranged with management.

3.     Respect Others.

Always treat all gym members and staff with respect. Don’t give unsolicited advice.

4.     Mobile phones.

Keep noise level to a minimum. Please take phone calls outside.

5.     Hygiene.

Maintain good personal hygiene.

6.     Dress Code.

Wear appropriate gym attire. This typically includes athletic shoes, shirts, and bottoms. No dirty boots or muddy footwear. Only closed water bottles or sports drinks are allowed in the workout areas. Avoid bringing food or open containers into the gym.

7.     Personal Belongings.

Keep tidy at all times. Do not leave in the way of other users.

8.     Clean Up After Yourself.

Wipe down machines and equipment after use.

9.     Litter.

We have rubbish bins spread throughout the facility, please use them, or take home with you.

10.  Personal Space.

Respect the personal space of others. Keep a reasonable distance when someone is working out.

11.  Equipment Care.

Use the equipment as it is designed to be used. If you're unsure about how to use a piece of equipment, ask a staff member for assistance. Return equipment to its designated place after use. Please put all your weights and bars back once you have finished with them. Please do not drop any equipment that is not designed to be dropped or in an area where the floor is not rubber matted.

12.  Safety First.

Prioritise your safety and that of others. Don’t perform exercises beyond your capability. Use spotters for heavy lifts – ask your fellow members or grab a member of staff. If you notice broken equipment or any safety hazards, report them to the staff immediately.

13.  Security.

Please do not prop the doors open.

14.  We urge all members arrive on time for any appointments with the fitness team or personal trainers.

15.  If you need to cancel an appointment, please let the club know with at least 4 hours’ notice. Failure to keep an appointment and or cancelling without adequate notice may result in a fine and the club removing your booking privileges. (see below)

16.  The club reserves the right to enforce and amend these rules as they see fit. Failure to comply with these rules could result in you being removed from the premises, your membership being terminated, a temporary ban, or permanent ban from the facility.

Personal Training & Coaching

Personal training should be arranged directly with the Personal Trainer. Personal Training is undertaken by qualified Personal Trainers. They are governed by their code of conduct and are insured under their own insurance. No other personal training or coaching is permitted unless advanced permission is gained from the General Manager.

 

Studio Classes

1.     Classes can be booked in advance through our online booking system or at reception.

2.     Maximum class numbers are determined based on the size of studio and the type of class. Once the maximum number is reached no other members will be able to enter the studio.

3.     Minimum class numbers will apply in order for a class to run. Classes that do not reach the minimum required may be cancelled at short notice. The club will endeavour to give as much notice as possible.

4.     Failure to turn up to a pre booked class may result in your booking privileges being removed.

5.     If you are unable to attend a pre-booked class, please cancel your booking through our online booking system or contact reception on 07929766032 before the class is due to start so your place can be re-issued.

6.     A minimum of 4 hours is required to cancel a class, less than 4 hours notice or no show will incur a fine of £4 The club can waive this in certain circumstances.

7.     The warmup is an important part of the class to reduce the risk of injury, so please arrive on time.

8.     Please inform the instructor if you have any injuries or medical conditions, or if your medical condition changes.

9.     For your comfort and the comfort of others we ask all members to wear correct footwear and unrestrictive clothing.

10.  An instructor may ask you to leave a class if you are behaving inappropriately.

11.  Due to unforeseen circumstances, it may be necessary for Club to change or even cancel a class at short notice. However, we will endeavour to provide as much notice as possible.

12.  Please leave the studio promptly after the class to allow the next class to start on time.

13.  Please do not enter the studio until the class before has finished and exited the area.

14.  Club require a minimum of 3 participants for a class to take place.

15.  Clothing, sports bags, and other personal items are not permitted in the studio area. Please use the storage cubes provided.

16.  Members may use the studio when classes are not taking place, please ensure that all equipment is put back after use.

 

Behaviour & Dress

Please behave appropriately when in or around the Club. Do not use foul, loud, or abusive language; do not act in a threatening manner. The Club will not tolerate violent or aggressive behaviour.

The Club may terminate your membership or may refuse you entry into the Club, or eject you from the Club, if you commit a breach of the club rules, or any other serious misconduct.

All complaints should be communicated to club management, or in writing through the feedback boxes / systems provided in club, or by post to the General Manager.

Please dress in suitable clothing whilst in the Club. Guidance as to suitable attire may be obtained from the General Manager who may, at his/her/their discretion, require you to leave club premises or part of the club premises, if you are not dressed appropriately.

 

Valuables

Please look after your valuables. The Club cannot accept liability for loss or damage to any property left in the club.

Please dispose of all litter in the bins provided. Please report the presence of suspicious individuals in the changing room to a member of staff.

 

Liability

The Club’s liability for damage or loss to member’s property is strictly limited to any damage or loss suffered because of negligence of the Club, its staff, or its agents. Without exception the Club will not accept liability for the safety of members, or their personal property brought onto the Club site, unless such property is handed to the Club reception & a signed receipt is given (this doesn’t include lost property). The Club reserves the right, in its absolute discretion, to refuse to store any such personal property of members. Property stored in storage areas provided by the Club, or its agents are stored at the owner’s risk and no liability for loss or damage will be accepted by the Club. Cars parked in the Club car parks or elsewhere on the premises and all the contents in them are left at the owner’s risk and the Club will not accept any liability for loss or damage in respect thereof. The Club cannot accept any liability for any accident to any member that may occur on the premises or within the grounds of the Club other than liability, which may arise from negligence of the Club, its staff, or its agents.

Any member who suffers an accident on the Club premises or in the Club grounds must report the accident, and the circumstances under which it occurred, to the Club Manager immediately following the accident.

 

Car Parking

The car park is available for members, visitors, and employees of the Club.

No unauthorised parking is permitted. Unauthorised parking and or a car parked incorrectly may be clamped and a fee may be charged for removal of the clamp.

We cannot accept liability for theft or damage to cars parked in the car park.

Members park outside the facility at their own risk.

 

Fire Exits

In the event of a fire evacuate through the front door.
